On 15 June 2023 the King’s Bench Division of the High Court in London handed down its judgment in Waste Managed Limited -v- Wilce and others. Gibson & Co. acted for three of the six successful respondents to an interim injunction application made to restrain alleged misuse of confidential information relating to a proprietary business model by ex-employees.
Murray HHJ found that there was no serious issue to be tried as to misuse and, alternatively, denied the injunction on the balance of convenience, on the strength of evidence served by the respondents and submissions from Trinity Chambers’ Simon Goldberg KC, Michael Haywood and (for the other three respondents, represented by Swinburne Maddison and Richard Reed) Paul Kerfoot and Morgan Brien.
