Toby graduated from Durham University in 1991 and qualified with Allen & Overy in 1995. He joined Slaughter and May’s Hong Kong office in 1997 for three years and was admitted as a solicitor there in 1998. He rejoined Allen & Overy on his return to London in 2000, staying with them until November 2003 when he joined Gibson & Co. as a partner.
He gained his higher rights of audience in the Civil Courts in 2001 and is a frequent High Court advocate, obtaining injunctions and representing clients at a number of interlocutory applications.
In Chambers, he maintains his top tier ranking for the tenth year running and is “Very effective and to the point, he has in-depth knowledge … quick to respond, and he does so with detailed options and analysis”, “very intellectually engaged and gets to the bottom of difficult points of law” (2022); “Toby is a master tactician and is always a step ahead of the opposition. Toby has handled a wide variety of contentious commercial and financial matters. His areas of expertise include: financial services and derivatives litigation, shareholder disputes, contentious trusts and probate matters, professional negligence and litigating over the terms of numerous commercial contracts (for example, distribution, share sale, asset purchase and option agreements). He has wide experience in arbitration, having represented ING Bank N.V. over the last four years in a series of LMAA arbitrations arising from the collapse of the OW Bunker business.
Toby regularly acts as a lead mediator on a range of disputes.
Toby’s interests outside the office include fell running and country sports.
